Analysis of the ideas and resources
Current System Flaws
1. Communication: This is the main and entire problem in a broken Immigration System. There is a lack of communication and understanding between the Federal Government and the State Governments, which causes the States to take Federal matters into their own hands. The results are having, in some cases, devastating outcomes for the States. Examples of such are the recent cases of Alabama, Georgia, Arizona, Utah and Indiana.
2. Control: This is the secondary core of the problem which is a consequence of the main core (communication). In the absence of communication, each State tries to gain control of the amount of illegal aliens that come into that State which may promote several racial/constitutional circumstances in the “hunt” of those illegal aliens that either have an expired Visa and/or who are undocumented; which may carry a considerable high cost of funds to each State. Therefore, there is a lack of control, due to the absence of relevant personal data (per person) and the inexistence of strict parameters of the law which should be applied.
3. Systematization: I will define as: “to arrange according to a definitive plan or scheme “. There is no systematic way in the current system to provide communication and control. I will not say now that Immigration is broken, but it is an obsolete Immigration system that has been patched over the years in order to provide solutions to the immediate necessities of the country. Every system supports only a determinate number of patches that, if exceeded, the result will incur an inefficiency to submit an adequate solution.
4. Decentralization: The system today is decentralized which reinforces the lack of control and communication problems. This situation is the cause that blinds lawmakers to achieve one suitable solution.
These are the four main problems that lawmakers didn’t contemplate in order to fix and update the current system. In the USA, we are living among domestic problems that don’t directly affect the Immigration System. Examples of that are Social Security and IRS methodologies to collect taxes. These two entities make it easier for the undocumented to mimetically live in the USA. Also these flaws open the door to unlawful necessity; giving rise to false or identity stolen (forged) documents.
One duty of the local police is to ask for proof of lawful residency. This may cause the police to make mistakes and engage the citizen as well. NO ONE KNOWS FOR SURE HOW AN ILLEGAL LOOKS, in most cases, because they do not have tattoos or special markings that identify them as such. Eventually, citizens can sue the State for harassment, or racism etc, which will cost to that State a considerable amount of money.
That idea is not wrong at all as was said before, it is an absence of control that allows this mistake. Lawmakers make the law based on their knowledge and ideas of how to avoid or prevent certain situations without analyzing the cause and the consequences of those IDEAS because in the analysis they do not contemplate the real parameters that create the situation. In the absence of strict parameters any law can be interpreted in many different ways and it will be applied according to the criteria of the individual who tries to apply the law.
Domestic Obsolete System of Social Security and the IRS
1. Social Security: Under the current system Social Security is just a number and one name printed with no way to verify the legitimate origins. Also, it allows aliases which provide an easy way to the unlawful citizen to acquire a Social Security Number under the felony of identity theft. This is due to the obsolete system that is currently available.
2. IRS: This office provides a TIN number to the unlawful citizens in order to allow them to work and pay taxes. Such a number contains the same format as a Social Security Number which may deceive police officers to apply the law.
These two departments are contributors that make it easier for an unlawful citizen to “mimic” within the USA communities and carry on with a “lawful life” inside the country. All these systems allow opportunistic people to forge papers easily so unlawful aliens can deceive police and citizens alike.
Flaws of the current Projects and Proposals to enhance border security are unworthy
1. Construction of the Border Fence: As an idea, it can be suitable, but extremely costly and would be affective for 1 year or less. It would be affective until the unlawful citizens find a way to jump over or dig under it and might reduce the unlawful citizens 10% the first year and then 5% thereafter. Which means in a term of 10 years the amount of unlawful citizens will reach 10 million more or less. This means that the investments of billons of dollars were misappropriated to solve the immigration problem temporarily.
2. Hiring more Border Patrol personnel: This will require a considerable amount of people to protect the borders which will cost more millions or billions of dollars to pay salaries and it will only return a 1% reduction of unlawful citizens.
3. Use of National Guard Troops: They are already on the payroll, but using them to protect the borders would be a waste of time because it will not reduce the amount of unlawful citizens that enter into USA. This resource can be applied in a better way to protect the entire country after a system of restructuring is done, which can make their job easier and give citizens security. This will in turn help save money without a need to move them to the border.
The projects mentioned are focused to eliminate the unlawful citizens, which seems IMPOSSIBLE. However, this project is using a technique of algorithms that can offer a solution to the entire local social problem with no collateral damage but with collateral benefits. It grabs the obsolete system and all the projects’/ideas that are exposed in several proposals, and attempts to solve our problems, and restructure to a new system that will have a cheaper cost (estimated between $100 and $200 million). It is my projection that this will solve the problem for the following 80 years which will be modifiable in specific ways that it will not need to be “patched”. It will also contemplate the situation of bribes to employees in order to gain an illegal entry into the country. The project doesn’t attempt to “avoid” illegal immigration into the USA; it is focused to “reduce” it in application to 85% - 95%. To reach 100% is Impossible due to the human factor of unpredictability to assume risks and ideas to violate the current laws but it can be controllable by the new system exhibited in my project.
The Project FUSA
Step 1:
It is developed in two parallel areas by the two powers: Executive and Legislative in order to gain control, while the Executive power works to apply one restructuring and the Legislative power has to work in the reinforcement of the current laws.
Step 2:
Application of the new system and modification of the actual databases, under the parameters of centralization and systematizations
Step 3:
Reduction of the current unlawful citizens to near or at 0
After the steps are applied, the system will give a full solution with collateral benefits. Thus, a reduction of funds currently spent to support the old system and having a result that decreases illegal immigrants to 85% under the current laws.
Then, 2 to 3 months are required to modify the application bases (computer programs) to the new system. Once the new system is implemented it will require 3 months thereafter, to start reducing the unlawful immigrants already in the USA.
Module restructuring: It will require that the Executive Power use the power vested, to implement the new Visa system and create a new office as part of Homeland Security. A possible veto of some laws, may be necessary, however, to explain this, we must first need to explain the Visa system and controls.
Module reinforcement: The Legislative Power must work together to cover loopholes in current laws. Legislation will need to reinforce the employment laws, the alien investor policies, housing policies and public plan policies as well. A severe increase in punishment will need to be implemented to people who incur infractions of the law, to secure the perfect functioning of the new system.
Restructuring
As the main measurement, we need to desperately secure the identity and personal information of all citizens.
In this project, I hope to achieve this by using the discrimination technique by grouping, so the result shows that it has 3 main groups.
Group 1: all the citizens born in the USA, as the constitution states: “any person born on U.S. soil is a USA citizen”.
Group 2: Identity Change can only be applied to the system of witness protection.
Group 3: Immigrants are all those individuals that live in the USA but are indigenous to another country.
At this point I will put aside Group 1 and Group 2 because the interest right now is Group 3.
Inside Group 3 we will find the following subgroups:
Group 3-1: lawful immigrants
Group 3-2: unlawful immigrants
Group 3-3: refugees
Lawful and unlawful immigrants have the same reason to migrate but unlawful citizens come to the country because they have no financial position to support themselves or because they cannot afford the requirements of the current Visas. There are no laws under which they can change their Visa status for each particular case. We could mention a common one, and that is same-sex-couples. In this case, the project will call them “unlawful citizens by necessity”. Last but not least, we can include those that have the need to be unlawful to proceed with criminal activities such as trafficking, and terrorism, etc.
1.- SS (Social Security) Modification
The system will provide and contemplate all the situations in order to provide the desired solution. The main concern is to provide a new kind of identification by using the Social Security Number. Meaning, we would make modifications in the system by adding one more number in the Social Security numbering system. This will exclude the local identification systems, such as State IDs and driver licenses, as the main documentation. In the system that I introduce there will be a number that will allow recognition of the individual State and Group. Currently, the number format of Social Security is 000-00-0000. Now the restructuring or modification is to start a system to identify the group the individual belongs so we need to add one more number (code) to identify that group. The proposed are the following codes:
1 = Citizen
2 = Resident
3 = Refugee
4 = Identity Change
5 = Temporary Workers and Investors
6 = Temporary Residents
7 = Right of Birth
8= Green Card holder
As an example, for citizens born in the USA, the process would be the same requirement as the birth certificate but renewable in 15 years. At the age of 15 the person will need to request a renewal in order to complete the data requirements for the new system. A fingerprint will be stored at this age in the database of the Social Security Department and has no expiration. For Immigrants that naturalize as Citizen, the same rules will apply. In the case of those under the age of 15, a temporary Social Security number will be issued. A permanent Social Security Number will be issued if they are 15 or older, the process would be the same for each group. Now Social Security will have to charge a fee of $35 dollars to get the Social Identification Card. That card should be similar to the ID card that each State gives to its residents (contain the same information) and it would be plastic with a magnetic band that holds the information. In the corner of the back would be a printed fingerprint. The information in the magnetic band should be the Social Identification Number, and the code. There will be no option to hold aliases and would be unique for each person which may require modification in its formats. It is recommended that one renewal at the age of 22 and from there renew it every 10 years. Each time the fee would be $35 or a fee adjustment (rare exceptions) if needed.
This modification will restructure and create a profit that will help the Social Security Administration create a collateral benefit to provide benefits to all citizens. It will make it more difficult to falsify Social Identification Cards and it will prevent identity theft issues. At the same time it will make it easier for the local police to discover people with false documentation and enforce the law. This would be done by checking the code (by swipe) of the Social Identification Number. It will also provide an easy way for companies to check the files of the person’s status because the person will have a unique identification.
2. IRS
The only modification that the IRS would need is the removal of the TIN number. Therefore, taxes are paid though the Social Identification Number as they are currently with the Social Security Number. The cost is nothing as this would be the last step in the procedures of the system.
3. Immigration
The obsolete Immigration System with all its modifications and limitations are what make it easier to come to the USA and remain unlawful. The current system not only requires a certain amount of money to obtain a Visa, the tourist Visa (or the B-1 and B-2), is one of the less costly. The approval or denial of the Visa is still a criterion of the Agent that works in the Embassy, which leaves room for bribes in some cases. The documentation needed to acquire a Visa for a person can contain documents that can be easily falsified. The verification of each document for each person that requests a Visa would take more personal time and money which will increase the backlog that currently exist.
The new Visa System will eliminate the backlogs that currently exist. The Agent in the Embassy will use the criteria and methods to verify forged papers. The Agent will create documentation for each person that tries to obtain a Visa and with the information the system can track the alien anywhere while in the USA.
Now the new system will require a readjustment to the current Visa type and assign a new nomenclature. It will include an Identification Card. The State Driver’s License will no longer be the main identification; there will be a new Federal Identification and Visa that is provided by Social Security, and the current Driver Licenses will reduce to just a permit to drive.
The first thing the system attacks is the backlog that is limited by the amount of Visas authorized per year. To gain control and remove illegalities, the system removes all the unlimited Visas. Under the new system they do not need to be limited, they need to be controlled.
Using the same technique to restructure SS, the system will create Visas with new requirements, and have new structures.
The last thing that the Executive Power would need to do is create a Federal Office inside Homeland Security that will house all of the Immigration information with a system that will automatically “flag” an individual if the status changes to illegal. The database is required be linked to the Social Security Administration Database and allow communication of databases within Embassy’s that hold Visa information.
This Department’s main function would be to detect, gather information and inform to whom it concerns when it comes to unlawful citizens. This is where other Federal Offices such as the FBI and Border Patrol, and even local police, will follow the current procedures of tracking the suspect(s), hold investigations, and interrogations. Therefore, normal procedures that are handled today should be followed in each case by the policies of that special Department.
Other responsibilities of this new Office (called Department of International/USA Affairs), would be the creation and total control of the automation system. We would build the system from the automation point of view; modify the system as needed with respect to design and codifications of modules that can improve the efficiency of the system.
All this can be applied before the reinforcement of the law is done. The next step belongs to the Legislative Power to reinforce and increase punishment to those that violate the laws as redefined by the law the USA Citizenship without going against the Constitution. In this area the Legislative experience is not quite stable but it can exercise its role in some aspects which will be required for the perfect functioning of the system.
Reinforcement
The first thing to redefine is how to hold Citizenship in the USA. One problem of many is how to avoid foreign persons coming to the USA and give birth and then remain in the USA. At the time the Social Security Number is requested, the parents should prove that they are lawful citizens of the USA. In the case of tourist, if they want their child to hold a USA Citizenship the Social Security Administration will issue identification with a Code 7 that would be valid until the age of 21. At 21, they will be allowed to leave the country or get deported (whichever comes first) with the child. At the age of 21 the child will have 5 months to renew the identification, and at renewal, this will allow the individual to hold a USA Citizenship. Failure to renew will cause the individual to permanently lose the USA Citizenship automatically.
In the labor force area, citizens would be verified by their working permits through the Social Identification Card or the Visa card where in this case, the work permit Code is 1. The contract should expire at the same time of the Visa unless it is renewed and the employer should submit a report to the “Department of International/USA Affairs” informing that the person will still work under a renewal, or, employment was ceased and has no further link with the company. Failure to do this and the company will be in violation and incur a felony and is subject to a fine.
Among citizens, those that provide protection by harboring foreigners of expired Visas, if caught, will incur of up to a $250,000 fine with 100 hours of community service or 2 years in prison with 100 hours of community service. It will be the duty of all US Citizens to report any person that remains in the USA with expired documentation to the local police.
Hotels and motels and other temporary residences should request valid identification. If the case involves a Visa Card, the person should be authorized so long as the Visa is valid. In case the person has an expired Visa the services should be denied and taken under custody by the security personnel until the police arrive. Failure to do so and that business will in violation and would be subject to severe penalties.
All businesses should verify the identity of a credit card holder. In the case of the foreign visitor only the Visa Cards and Social Identification Cards should be allowed as valid documentation in the USA. If the personnel comes across an expired identification and it is a Visa they should inform the police immediately and use their security personal to take custody of the person until local police arrives.
Those who are in violation of the Visa law will either spend 1 year in prison and/or be immediately deported to their own countries. They will be permanently denied entry going forward.
Once this is resolved and the loopholes closed the Executive Power can issue a Legalization Plan for those that are currently in the country. The Legalization plan I propose is as followed:
Request to all the illegal aliens to file to the Immigration Department the petition of Legalization. As punishment for the offense they should pay all the form fees, a fine of $7000 that can be made in payments or taken with their taxes and a letter signed by the individual that he or she resigns their original citizenship, take English and Civil Education Classes. A thorough background check must also be performed to recognize offenders or any other possible threats to the country. Immigration will then send a simple letter authorizing the Social Security Administration to issue a Social Security Card. The time that people have to file their paper work to the Immigration Office should be within 7 months. The reinforcement and the legalization should be announced the same day and make it available the same day as well. Or introduce the legalization plan and on the 7th month implement the reinforcement of laws. This second option will just avoid misunderstanding between the illegals and the police. At the time the legalization plan is announced all old documentation including driver licenses will no longer be valid as the main identification. All Citizens will have to show the Social Identification Card with the driver’s license if it is requested.
The legalization plan is to protect the USA economy as the main concern and reduce the number of illegals in the USA to or near to ZERO. The system will reduce the illegal immigration up to 70% at this point and make it easier to track those that are unlawfully in the country.
At this point the system also generates a class of illegals by necessity and those who are same-sex-couples. In order to eliminate this, the Government should remove the DOMA Law and accept any legal marriage made in the US. Same-sex-couples will be able to go to the State(s) where the marriage is allowed and obtain the certificate to a posteriori and file it to the Immigration Department in order to get the spouse the Visa R-34. This will reduce the Illegal Immigration up to 90-95%. However, there will remain those that have the need to be illegal in the USA in order to commit felonies such as trafficking and terrorism. But they would be easily tracked either by the use of credit cards or the information of entry that remains in the “Department of International/USA Affairs”.
The time line to apply the project is estimated to 11 months with a cost of $100-$250 million dollars annually to maintain the system and pay salaries in the new office. This project will generate for the SS Administration estimated $9,902,366,140 in profits & revenues and from the Immigration Reform the first year, the US Government would gain an estimated $120,000,000,000 in profitable revenues.
